terms and conditions for our yoga classes,COURSES, passes and discounts

TERMS & CONDITIONS ARE AS FOLLOWS:

1. BOOKING CLASSES
The cost of each regularly scheduled class may be covered by a drop in purchase, a 5 class pass, or an unlimited class pass. Additional classes, workshops, courses and events hosted/taught outside of our regularly scheduled classes may be paid for at the time of booking on our website. Some classes, workshops, courses and events will require payment immediately at the time of booking and will indicate such during the booking process.
2. PAYMENT FOR DROP-IN CLASS
If you wish to pay for classes/workshops /courses/promotions via the pay-as-you-go/drop-in option: Payment for your class/event/course/workshop may be made by cash, credit card, debit card or PayPal. Payments can be made online with a credit card, debit card or PayPal account. Payments can be made in person at Blossom Yoga Center by credit card, debit card, or cash.
3. PAYMENT FOR CLASS PASSES
You can purchase a 5 class pass or an unlimited class pass, online via our website or in person at Blossom Yoga Center. Drop-in/single-class-passes must be used within a 1 month period of the purchase date and, after this period, any unused credits will expire. 5 class passes must be used within a 3 month period of the purchase date and, after this period, any unused credits will expire. Unlimited class pass is valid only for one month with unlimited credits during the period of that month from the date of purchase. Class passes are assigned to individual client accounts and cannot be shared between clients. Passes cannot be suspended or extended.
4. PAYMENT FOR A COURSE
You can pay for a course online via our website with a credit card, debit card or PayPal account. Booking of a course is for specific set of dates that are understood during the time of booking. There may be health, skills, or prior course completion based pre-requisites for such courses, or you may be required to fill out an additional forms as a pre-requisite to attending some of our courses. If you are unable to fulfil such pre-requisites, your participation may be cancelled and booking fees refunded.
5. CANCELLING YOUR BOOKING, LATE CANCELLATIONS + NO SHOWS FOR CLASSES
You may cancel your booking without charge. If you are on a 5 class pass, an unlimited class pass, or have paid a drop-in fee, upon cancellation prior to the class or a no show, the credit will not be used and remain on your account. In the event of late arrival to a booked class you will be charged for the class, and we will not be able to process a refund, nor will we be able to return your used credits. You may cancel the class by clicking the “Change/Cancel Class” button in your class email confirmation and follow the instructions, or you may send us an email or call us over the phone.
6. CANCELLING YOUR BOOKING, LATE CANCELLATIONS + NO SHOWS FOR COURSES
If you have paid for a Yoga course hosted/taught by the Blossom Yoga Center, you may cancel up to three weeks before the scheduled course start date. This will allow us to offer your spot to another participant. Cancellations made 21 days or more in advance of the course start date will receive a full refund minus any payment processing fees. Alternatively, we can credit your payment toward a future course. Cancellations made within 10-21 days will receive a 50% refund. Cancellations made within 10 days of the course start date or after the course begins will not receive a refund unless there are exceptional circumstances which will be reviewed on a case-by-case basis. 7. MAKING A CHANGE TO YOUR CLASS BOOKING
You may change your booking for a yoga class, up to 1 hour before the start of your class that you have booked. You may change the class booking by clicking the “Change/Cancel Class” button in your class email confirmation and follow the instructions, or you may send us an email or call us over the phone.
8. MAKING A CHANGE TO YOUR COURSE BOOKING
You may change your booking dates for a yoga course to another set of dates for the same course up to 10 days prior to the start of the course, provided there is space availability in another course period. You may request the change in your class booking through email or by telephone. Otherwise we suggest that you cancel your spot and take a refund, and book again when a course becomes available on your preferred set of dates.
9. IF WE CANCEL YOUR BOOKING
In the event that we cancel a class, classes or a course that you have booked, we will contact you by email or telephone to let you know. At the time of cancellation we will offer you the choice between: 1. crediting your account with the price of the cancelled class; or 2. being transferred to a class or course at an alternative date and time; or 3. processing a refund.
10. BOOKING CONFIRMATION
Your booking is not complete until you have received a booking confirmation via email from us. Please make sure you receive a booking confirmation before you attend the class. If you do not receive confirmation please contact us by phone or e-mail. Prices are subject to change at any time before we accept your booking. All classes are subject to availability. We do not guarantee availability at any time.
11. CHANGE OF PRICES
We reserve the right to review and change the price of our classes and memberships at our sole and absolute discretion. Your class passes and credits will remain valid throughout your contracted period. Once your contract period has come to an end, any subsequent class passes purchased will be at the revised rates at the time of the renewal.
12. DISCOUNTS
Discounts for Senior Citizens, Students and Veterans are subject to the participant being able to present valid government issued ID that verifies this status at the time of arrival to the class. The studio reserves the rights to deny participation in the class, or requests the price of a regular class or regular class pass price upon the inability of a participant to prove ownership of the appropriate ID.
13. CANCELLATION OF CLASS PASS
Once purchased a class pass cannot be refunded. You may use the class pass during the period it is valid, and once the period is complete, any unused credits will expire. A class pass cannot be transferred or shared with any other person. Blossom Yoga Center is committed to the safety and welfare of yoga students and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior. Blossom Yoga Center has the right to judge behavior and respond accordingly. This right includes, but is not limited to, cancellation of class passes without refund of any student engaging in unacceptable behavior. Yoga students who do not observe Blossom Yoga Centers rules and regulations or who abuse equipment in any fashion will be asked to leave. Blossom Yoga Center reserves the right to terminate class passes of anyone who refuses to observe any of Blossom Yoga Center’s rules. Not all rules are listed in these terms. Blossom Yoga Center reserves the right to add, change or remove rules and conditions of membership.

14. FORCE MAJUEURE We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labor, fuel, parts or machinery, power failure or breakdown in machinery.
15. WAIVER No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.
16. SEVERABILITY If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
17. ENTIRE AGREEMENT These Terms constitute the entire agreement between the parties and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between parties.
18. GOVERNING LAW AND JURISDICTION These Terms shall be governed by and construed in accordance with United States of America law and the parties hereby agree to submit the exclusive jurisdiction of the United States of America.
